Persoanele care efectueaza activitati in procesul de emigrare in Canada in schimbul unei plati trebuie sa fie autorizate de autoritatile canadiene.
Autorizarea este obligatorie pentru toate activitatile, chiar si pentru cele anterioare initierii propriu-zise a cererii de emigrare cum ar fi: sfaturi privind emigrarea, indrumari privind alegerea programului de emigrare, analiza incadrarii candidaturii in cerintele pentru emigrare, completarea formularelor.

It is important to know that anyone who represents or advises you for payment or offers to do so in connection with immigration proceedings or applications is breaking the law unless they are an authorized representative or they have a specific agreement or arrangement with the Government of Canada that allows them to represent or advise you. This applies to advice or consultation which happens before or after an immigration application is made or a proceeding begins.
Authorized representatives are:
- immigration consultants who are members in good standing of the Immigration Consultants of Canada Regulatory Council (ICCRC);
- lawyers and paralegals who are members in good standing of a Canadian provincial or territorial law society and students-at-law under their supervision;
- notaries who are members in good standing of the Chambre des notaires du Québec and students-at-law under their supervision.
If you appoint a compensated representative who is not a member of one of these designated bodies, your application will be returned.

Bill C-35 strengthens the rules governing those who charge their clients for immigration advice or representation, making it an offence for anyone other than an accredited immigration representative to conduct business for a fee or other consideration, at any stage of an application or proceeding.
At its core, the Act amends the Immigration and Refugee Protection Act (IRPA), making it an offence for anyone other than an authorized representative to conduct business, for a fee or other consideration, at any stage of an application or proceeding. This includes the period before a proceeding begins or an application is submitted and means that anyone who provides paid immigration advice at the pre-application stage will need to be an authorized representative, as identified in section 91 of the Act.
Immigration representatives must be either members in good standing of a provincial or territorial law society, including paralegals; members of the Chambre des notaires du Québec; or members of the governing body for immigration consultants.
A 120-day transitional period will be put in place to ensure a smooth transition and continuity of service for both CSIC members currently in good standing and their clients during the transition to the ICCRC. The transition period will end on October 28, 2011.
Emigrarea în Quebec
Incepand din Februarie 2011, doar specialiști autorizați de Immigration Québec au voie sa va reprezinte in procedura de emigrare in Quebec.
Conform reglementarilor Autoritatilor de Imigratie, pot fi autorizați doar:
- les membres en règle du Barreau du Québec = Avocați, membri în regulă în Baroul Quebec;
- les membres en règle de la Chambre des notaires du Québec = Notari, membri în regulă în Camera Notarilor Quebec;
- les personnes titulaires d’une autorisation spéciale délivrée par l’un des deux organismes précédents = Titulari ai unei autorizări speciale emise de una din cele doua instituții precedente;
- les consultants en immigration reconnus et inscrits au Registre québécois des consultants en immigration (PDF, 259 Ko) = Consultanți în imigrație înscriși în Registrul consultanților de imigrație din Quebec.
Feriti-va de consultanti ne-autorizati. Acestia va incaseaza banii fara sa poata oferi servicii autorizate.
Cereti intotdeauna NUMARUL DE INREGISTRARE in BAROUL QUEBEC, in CAMERA NOTARILOR sau in LISTA CONSULTANTILOR AUTORIZATI.
Consultantii ne-autorizati nu va pot reprezenta si nu pot interveni in nici un fel in procesul de emigrare. Veti plati banii degeaba.
Iata cateva din tertipurile folosite de consultantii neautorizati pt a insela clientii:
- ofera asistenta in vederea accederii de catre client in nume propriu la obtinerea vizelor
- nu semneaza contract de reprezentare/ asistenta pt procesul de emigrare
- firma afirma ca iti garanteaza plecarea iar tu iti asumi meritele procesului
Oficial, aceste firme nu apar nicaieri in procesul de emigrare.
Mai mult, incepand cu oct 2011, aceste practici devin INTERZISE
Daca ati intalnit “firme de apartament” ori consultanti obscuri care functioneaza fara autorizatie, puteti posta pe BLOG numele si adresa acestora ca sa ne ferim sa fim inselati.
